Court denies request for temporary restraining order against Detroit teachers

LANSING, Mich. – The Michigan Court of Claims has issued an order Thursday denying the request for a temporary restraining order filed by the Detroit Federation of Teachers.

The court issued a notice and order to appear for a show cause hearing on Jan. 25 at 11 a.m. in the case of Detroit v. Detroit Federal of Teachers et. al.

The hearing will be held in Detroit and Judge Cynthia Stephens will hear the case.

The district filed a lawsuit and request for an injunction naming the teachers’ union, activists and two dozen teachers as defendants.

DPS released the following statement:

"It's extremely important that the court play a role in the resolution of this issue. We look forward to the opportunity to inform the court of the serious effects that these continued sick outs have on the District, its students and their families at the hearing on Monday."

Detroit educators are protesting Gov. Rick Snyder's plans for the district, its finances, their low pay, dilapidated buildings and overcrowded classrooms.

“The DFT is pleased that the court denied the district's request for an immediate retraining order. We Look forward to continuing the fight for our members, our community and the schools our kids deserve,” Detroit Federation Teachers Interim President Ivy Bailey said in a statement.

The massive sickout by teachers on Wednesday closed more than 85 of the struggling district’s roughly 100 schools. Protests were held in front of Cobo Center where President Obama was set to visit the auto show.

The closures came after more than 60 schools were closed Jan. 11 because of an absence of teachers.
