DETROIT – Former Subway pitchman Jared Fogle is suing the parents of a girl he victimized, saying they are responsible for her emotional distress.
In court documents filed this week, Fogle is asking a judge to allow him to add the parents as defendants in a lawsuit the parents filed against him in March.
The request is a response to the allegations that Fogle caused the girl emotional distress when she was videotaped at Russell Taylor's home.
Last year, Fogel agreed to plead guilty to engaging in sex acts with minors and receiving child pornography.
The agreement filed by prosecutors says he agreed to: pay $1.4 million in restitution to 14 minor victims, each receiving $100,000, register as a sex offender and undergo treatment for sexual disorders.
Fogle was sentenced to 15 years and 8 months -- three years more than federal prosecutors had recommended.
Fogle first rose to fame after Subway promoted his story in its marketing campaign -- he lost 245 pounds by eating the company's sandwiches twice a day.
Fogle worked for Subway for 16 years but the company was quick to distance itself and fired Fogle when the accusations surfaced.
In the court appeal, Fogle's lawyers cite the positive impact of his weight loss story:
"After suffering the physical, mental, and emotional distress that can come with being morbidly obese, Fogle spent countless hours over the last eighteen years speaking with people around the world about his struggles to get healthy."
