Kroger cake-kicker sentenced in ice cream shop assault

Woman made headlines for drop-kicking cake at Kroger in Bloomfield Township

ROYAL OAK, Mich. – She initially made headlines for drop-kicking a cake at a Kroger in Bloomfield Township. That same woman was sentenced Monday morning for an assault against an employee at an ice cream shop in Royal Oak.

Tricia Kortes, 46, was sentenced to two years of probation, over $800 in fines and fees and a continuation of her 300 hours of community service from a prior case.

The assault and battery happened in July of 2015 at Ray’s Ice Cream. Video surveillance showed her strike the worker because they ran out of Mackinac Island Fudge. That worker, Linda Walner, was in court during the sentencing.

“I just want her to realize that she can’t go around hurting people,” Walner said. 

Walner saw a newspaper in June 2016 describing the incident at the Kroger. Kortes had ordered a “Batman vs. Superman” cake from the store and became upset when employees refused to allow her behind the bakery counter to change the design and drop-kicked the cake. Walner saw a photo of Kortes in the article and recognized the woman as the person who assaulted her.

Kortes told the judge the media is casting her in a bad light and that she has been attending anger management since these incidents.

“I have completed the anger management class and I've been continuing to complete therapy,” Kortes told the judge.

In 2015, Kortes pleaded no contest after getting into a fight with a co-worker in Troy. In July of the same year, the ice cream assault occurred and the cake-kicking incident happened in June of 2016.

“Three issues within the span of a year,” the judge said. “Most people walking on this planet are not going to have one issue in a year and you have three in one year.”
