Warren man accused of racing drunk, causing fatal rollover crash

48-year-old man from Detroit killed after being ejected from vehicle

WARREN, Mich. – A 33-year-old man from Warren has been charged with 15 felonies in connection with a fatal crash Saturday, March 2.

According to authorities, the crash happened at about 1:45 a.m. on Groesbeck Highway, near Stephens Road. Police believe Xaiver Fuggerson was the driver of a Chevrolet Impala that was racing a Tahoe that contained people he had been socializing with prior. The Impala reportedly came in contact with the Tahoe, which rolled over and ejected all five occupants. The driver of the Tahoe, a 48-year-old man from Detroit identified as Dennis Smith, died at the scene. The four passengers were seriously injured.

Police said Fuggerson’s blood alcohol content was roughly twice the legal limit.

Fuggerson was charged with operating while intoxicated causing death, reckless driving causing death, operating with a suspended license causing death, four counts of operating while intoxicated causing serious injury, four counts of reckless driving causing serious injury and four counts of operating with a suspended license causing serious injury. He is being charged as a habitual third-offender.

Bond was set at $1 million cash/surety with an alcohol and GPS tether required if bond is posted. Police said Fuggerson had previous felony convictions and had multiple open suspensions on his driver’s license for various tickets. He is expected to return to court March 21.
