Michigan has warned Ecoshield to amend the cancellation policy in its contracts so they comply with state law or the company could face legal action.
Ecoshield Pest Solutions Detroit, LLC (Ecoshield) sells pest control services to Michigan residents through door-to-door solicitation.
Michigan’s Department of Attorney General sent a notice to Ecoshield, warning the company to amend its contracts to comply with the Michigan Home Solicitation Sales Act (HSSA) and the Michigan Consumer Protection Act (MCPA).
The Michigan Home Solicitation Sales Act makes it so consumers have three days to cancel door-to-door sales contracts and receive a full refund. According to the Department of Attorney General, Ecoshield’s contracts allegedly include language that attempts to waive consumers’ cancellation rights due to an emergency and their rights to refunds for payments made for services rendered before a timely cancellation. The contracts did not have the required notice of cancellation form.
The Department of Attorney General discovered the issues after residents complained to the department.
“Consumers have the right to take their time, ask questions, and avoid pressured on-the-spot decisions. Any deceptive tactics should be reported to my office,” Michigan Attorney General Dana Nessel said.
If Ecoshield does not comply with the law, the Department of Attorney General may initiate a formal investigation or litigation.
