Richard McBrayer was convicted in 1994 of two counts of first-degree criminal sexual conduct and sentenced to 20-40 years in prison. McBrayer, 61, was 36 years old when he pleaded guilty to raping the child multiple times over two years. Macomb County Prosecutor Eric Smith filed an emergency motion to appeal the decision. Smith also appealed McBrayer's parole in 2011 and 2013.
